Terms & Conditions

All membership rules outlined in this Agreement apply equally to members, shared members, temporary members, and
guests. These rules are intended as a general guideline to our policies and do not cover every possible situation. The
Club reserves the right to address circumstances on a case-by-case basis in accordance with the Club’s discretion and
applicable laws. The club reserves the right to refuse service to any individual at its sole discretion, without
explanation, to maintain a safe and positive environment for all customers and staff.

Memberships:

All memberships are Non-Transferable & Non-Refundable.

Image Fitness is a private members-only club, and the Club reserves the right to refuse membership to any individual without cause. By joining the club, Members automatically accept and agree to be bound by these conditions of membership.

Entry will only be permitted to those with a valid membership, in date and in credit. If you have an amount due to be paid on your account, you won't be able to enter the building.

In the event that your Access Credentials or key fob does not allow entry to the building for any reason (e.g., it is defective, damaged, or your membership is not paid in full), this does not grant you the right to tailgate or gain unauthorized access. Please contact the Club to resolve any access issues.

As a member, you agree to comply with the rules of the club regarding the use of the facilities, opening hours, and your conduct. The Club may make reasonable changes to these rules from time to time and is not required to give you advanced notice of these changes.

You exercise at your own discretion and accept any injury or illness brought on by exercise as your own responsibility.

Contact Information: Member confirms that the mailing address, phone number, cell number, and email provided on this Agreement are accurate and voluntarily given. The Club, its agents, and affiliates may contact the Member at these details, or any updated contact information provided later. Members agree to promptly notify the Club of any changes by updating the information online through the Member Portal, by phone, or via email.

 

Health, Injury, and Safety Guidelines:

Injury and First Aid: In the event that you or another individual becomes injured:

  • For serious injuries that need medical treatment, dial 911

  • A basic medical supply box is available at the front desk

  • All accidents, incidents, or problems with services, equipment, and facilities must be reported immediately to 770-299-9511.

Fire: In case of a fire, or if you smell or see smoke, exit the building immediately and all 911 immediately from a cell phone or business nearby.

 

Proper Attire: The Club requires you to wear appropriate clothing and footwear while in its facilities such as gym shorts, T-shirts, undergarments or tights with all apparel, jogging, aerobic and sweat outfits, clothes that have not been torn or altered. Street clothes/shoes, jeans, and work boots are not appropriate. The Club recommends closed toed shoes be worn on the general workout floor at all times, and wearing opened toed shoes or socks alone is at your own risk.

Lockers: Lockers are available on a first come, first serve basis during your workout. No member shall leave any items or personal belongings in the lockers overnight. All locks left overnight will be removed at the owner’s expense and contents stored with management. It is recommended to use a lock to secure your items in a locker. The Club is not responsible for items or belongings left or stored in lockers as the lockers are available at member will.

No Unauthorized Personal Training: Personal training sessions within the Club must be conducted exclusively by trainers who are employed by or contracted with the Club. Independent personal trainers (or similar prescriptive-based instructors) are not permitted to provide or appear to provide training services inside the Club. Violation of this policy may result in the loss of membership privileges for all involved parties.

Cleaning of Equipment and Surfaces

Use of Image Fitness Cleaning Products: Only Image Fitness-provided cleaning products are to be used to clean equipment and surfaces. These products are specifically chosen to ensure effectiveness, safety, and to prevent damage to the equipment.

Before Use: Members are encouraged to clean equipment before use for their own health and safety. This includes wiping down all surfaces of the equipment that will come into contact with skin.

After Use: Members are encouraged to clean equipment after use for the benefit of others. This includes wiping down all areas of the equipment that may have been touched or used during the workout.

Shared Surfaces: In addition to equipment, members are encouraged to clean any shared surfaces they may come into contact with, such as mats, benches, and machines.

Respect for Shared Spaces: At Image Fitness, we value the comfort, safety, and enjoyment of all members. To foster a respectful and inclusive environment, we ask that members adhere to the following policies regarding shared spaces:

Personal Hygiene and Fragrance Policy

Hygiene: Members are expected to maintain proper hygiene by wearing clean workout attire and using deodorants or antiperspirants to manage body odor.

Fragrance Use: The use of strong perfumes, colognes, smoke or other scented products is discouraged, as these can trigger sensitivities or allergies in others.

Discretion and Courtesy: Be mindful of how personal odors—whether natural or from products—may impact the shared workout environment.

Personal Listening Devices and Noise Control

Headphones Recommended: We strongly suggest that members use headphones when listening to music, podcasts, or other audio on personal devices. Playing audio aloud on phones, tablets, can disrupt others.

Respectful Use: Avoid using speakerphone or engaging in loud phone conversations while in the gym. If necessary, please step into a designated area or outside to take calls.

Enforcement: Staff and trainers may discreetly address infringements of this policy with individuals as needed. Repeated issues may result in suspension of membership privileges.

Outside Equipment: The Club reserves the right, in its sole discretion, to limit or restrict the use of outside equipment in the Club.

Facility Usage

Credit Card on File: Members may elect to keep a credit or debit card on file using their Member Portal. By placing a card on file, the cardholder and account holder gives permission to the Club to charge the card for any memberships set up on Automatic Payments, and/or cancellation/no-show fees accrued in accordance with the Personal Training Policy detailed below.

On-Account Purchasing: Any credit card on file can be used to make on-account purchases at the front desk in the Club for products and services. These on-account purchases will be billed to your card on file as they occur. You are not required to keep a credit card on file unless you are a Training Client. If you wish to remove or change the card on file, please contact us at 770-299-9511 or log into your Member Portal. It is the Member’s responsibility to maintain correct billing information on their account.

Automatic Payments: If you have agreed to the Automatic Payments Terms & Conditions, your membership fees will be automatically charged based on the period and duration of the membership plan you selected. Please note that we do not send reminders or notifications before processing these charges, so it is your responsibility to remain in compliance with the Automatic Payments Terms & Conditions.

Payment and billing

Club Access Hours and Temporary Closures: The Club reserves the right to adjust access hours as necessary to ensure the proper operation and maintenance of the facility. Occasional closures may be required for purposes such as maintenance, equipment upgrades, power outages, inclement weather, emergencies, or compliance with government-mandated restrictions (e.g., pandemic-related closures). The Member acknowledges that no extensions or refunds will be provided for such closures, and membership terms will remain unaffected.

Security: The building, parking lots, and Club premises are under 24-hour video surveillance. Whether you are working out, moving throughout the building, or entering/leaving the building, your activities are recorded. This video system is used for security purposes. The surveillance system does not protect you from harm on the building premises. You must use caution when entering or leaving the building. Never allow access to individuals who knock on the door; doing so may put you and others at risk of injury or harm and could result in the loss of your membership privileges.

Entrance/Exit Doors: Members MUST use the member door to enter and exit the building. The back door/s will set off an alarm when opened.

Club Access, Security, and Maintenance

All Members participating in or wishing to participate in personal training services (hereinafter "Training Members") must have a current, paid membership. You may request a Coach, or one will be assigned to you based on your needs and availability. Coach schedules are posted on the Club website or on the Member Portal service page; schedules and availability are subject to change.

Health & Fitness Questionnaire (PAR-Q & YOU): All Training Members are required to complete a Health & Fitness Questionnaire (PAR-Q & YOU) form prior to training. This questionnaire can help identify pre-existing medical conditions that may be aggravated by physical activity. It can also identify certain lifestyle factors that contribute to your overall health and wellbeing. Depending on your answers, you may be required to complete a follow-up questionnaire and even seek medical clearance from your physician before participation in any training sessions. You are expected to answer truthfully and to the best of your knowledge. You may be required to complete a new questionnaire as requested by your Coach as your training journey progresses.

PAR-Q & Medical Clearance: A medical clearance form may be required of all Training Members who answer ‘yes’ to any of the PAR-Q questions on the Health & Fitness Questionnaire (PAR-Q & YOU) questionnaire. Coaches reserve the right to require medical clearance from any client they feel may be at risk.

Session Types: The Club offers the following training services. Training services in these terms means the training, coaching and/or related services you purchase from us which may comprise one or more of the following (as agreed in writing between us):

Personal Training – 1:1, 2:1, or 3:1 sessions, or small group sessions with one of our Coaches at the Club,

Virtual Training – 1:1, 2:1, or 3:1 sessions with one of our Coaches through our any mode of approved virtual methods,

Group Training / Classes – group training or class sessions with one of our Coaches;

Nutrition Information – individual review of general nutrition and supplement information regarding healthy eating based on the Client's goals that is provided solely as general education and informational purposes.

ATTIRE: Come prepared to each training session in proper workout attire and footwear according to the Proper Attire section of this agreement. Participants arriving unprepared for their training session may be required to reschedule their session if the Coach determines that there is not enough time to complete the session. See Tardiness.

CANCELLATIONS, CHANGES, RESCHEDULES: The client understands that Coaches operate on a scheduled appointment basis for all sessions and thus require a 12-hour notice when the Client needs to cancel, change, or reschedule an appointment. No charges shall be levied should the Client request the cancellation, change, or reschedule with more than a 12-hour notice. Should the Client cancel, change, or reschedule their appointment within the 12-hour window, the Client will be charged a $20 fee per occurrence and the Client's session will be rescheduled during the Coach's next scheduled availability.

TARDINESS:

CLIENT: It is important to arrive on time for all scheduled appointments. The Client understands that the Coach may have another appointment immediately following the session. If the Client is late for his/her session, the session will still end at the scheduled time unless the Coach is able to provide the Service to the Client for the full time if the schedule allows and at the Coach's discretion.

COACH: Coach must make up any lost time due to their tardiness with the Client at no additional charge.

NO CALL / NO SHOW: If the Client is more than 15 minutes late for a session and has not notified the Gym or the Coach, it will be considered a no-call / no-show, and the Client will be forfeit the session and the session price and must reschedule and pay for another session. You must receive confirmation that we have received your notice in order for it to be valid.

EMERGENCIES: We understand that emergencies happen. We provide every Client with ONE (1) FREE short-notice cancellation within a 6-month period. The Client will not be charged for the first cancellation with less than 12 hours’ notice. Subsequent short-notice cancellations will be charged the $20 fee. The free short-notice cancellation only applies if we are notified (and the Client received confirmation that we received the cancellation notice) prior to the session start time. No call / no-shows are not eligible for the FREE short-notice cancellation waiver.

REFUND POLICY: There will be no refunds for Services. Paid and unused sessions will remain as a credit on the Client's account for a period of 90-days (except for those packages or promotions where the sessions must be used within a specific time frame) and can be used towards these covered Services only. If not used within the 90-days, any unused credit will be forfeited with no refund issued.

YOUR RIGHTS TO MAKE CHANGES: If you wish to make a change to the Services you have purchase please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the Services, the timing of the Services or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

OUR RIGHTS TO MAKE CHANGES: We may change the Services:

From time to time we may need to make changes to your allocated Coach;

to reflect changes in relevant laws and regulatory requirements;

to implement minor adjustments and improvements; and

if your medical and health situation changes to an extent that requires amendments to the Services.

Personal Training

Tanning Bed Usage: It is our intention to keep you as well informed about tanning as possible. This means informing you how to operate the tanning equipment. The proper procedure to follow in the tanning room will be clearly posted outside the tanning room. Please feel free to ask any questions. If you do not develop a tan outdoors, you are unlikely to tan from the use of any tanning device.

AVOID OVEREXPOSURE. As with natural sunlight, overexposure can cause eye and skin injury and allergic reactions. REPEATED OVEREXPOSURE may cause photo aging of the skin, dryness, wrinkling and in some instances skin cancer. We recommend that you do not tan outdoors on days you are tanning indoors, that you do not tan if you currently have a sunburn and that you, at most, tan only once in a 24-hour

CERTAIN MEDICATIONS, LOTIONS AND OTHER PRODUCTS may cause your skin to be more sensitive to UV Rays. Check the posted list of drugs and products known to increase photosensitivity of the skin. Check with your physician or pharmacist if you are unsure about any medications, you are taking or if you have had a problem with indoor or outdoor tanning in the

WEAR PROTECTIVE EYEWEAR. Failure to wear protective eyewear may result in severe burns or long-term injury to your eyes. Complimentary disposable eye protection is available for use in the tanning room

Tanning Rules:

Must have current paid membership and signed agreement to tan. No guests allowed.

Know your skin - take the ASA skin type quiz at Access & Security:

Each individual must swipe their Member Credentials at every door. Do not hold doors open for others, as this may result in fees or membership suspension.

No sharing of Member Credentials is allowed. No tailgating.

No one under 14 years old is allowed to tan

Anyone between 14-17 years old must have paid membership and adult present

Always clean the tanning bed before and after use. Only Image Fitness-provided cleaning products are to be used to clean equipment and surfaces. Protective eye wear must be worn

Do not go over the time limit set for the bed or set the timer for extra time

You may only tan one time in a 24-hour period. Keep track of your visits.

Turn off fan and light before you leave

Care for the facility and equipment. All accidents, incidents, or problems with services, equipment, and facilities must be reported immediately to 770-299-9511.
